Terms of Service

The agreement that applies when you use the Data Reporter reporting workspace at cuigg.me.

Who we are

WinnerFlags ("we", "us") operates Data Reporter, the private client-reporting service at cuigg.me. Questions about these terms: winnerflags@gmail.com.

The service

Data Reporter is a managed reporting workspace. We set up accounts for the organisations we work with; there is no self-serve public signup, and members of those organisations use the workspace to read the reports produced for them. The service agreement between us and your organisation governs commercial terms; these terms govern your use of the workspace itself.

Accounts

  • Your sign-in belongs to you. Keep your credentials private and don't share your account.
  • Tell us promptly if you believe your account has been compromised.
  • We may suspend an account that puts the service or other customers' data at risk.

Acceptable use

Don't use the workspace to break the law, don't attempt to access another organisation's data, and don't probe, overload or interfere with the service's security or operation. If you find a security issue, we'd genuinely like to hear about it, see our security page.

Your data

The survey and audience data your organisation supplies, and the reports generated from it, remain your organisation's. We process that data to provide the service, as described in our Privacy Policy. When our contract with your organisation ends, we delete its workspace data within 30 days unless the law requires otherwise.

Our materials

The software, design, templates and documentation that make up the service remain ours. We licence you to use them through the workspace for as long as your organisation's agreement with us is active.

Availability

We work to keep the service available and dependable, but it is provided "as is": we don't promise uninterrupted availability, and short maintenance windows sometimes happen. Any specific service levels are those agreed in your organisation's service agreement.

Liability

Nothing in these terms excludes liability that cannot be excluded under applicable law. Subject to that, we are not liable for indirect or consequential losses, and our total liability arising out of the service is capped at the fees your organisation paid us for it in the twelve months before the claim arose.

Changes

If we change these terms in a way that matters, we'll update the date above and flag the change in the workspace. Continuing to use the service after a change means the updated terms apply.

Governing law

These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction over any dispute arising from them.
